2. Residency in Spain & Business Visa for Investors

New Spanish legislation granting Residence Permits

The Spanish Parliament recently approved a new bill that allows foreign individuals to obtain a residence permit if they are qualified as investors, entrepreneurs, highly qualified professionals, investigators or workers engaged intra movements within the same company or group of companies.

The most relevant is the cases of investors and entrepreneurs.

What are the options to obtain residency in Spain or a business Visa?

A. Investors:

The residence will be granted in case of an acquisition of real estate / buying property in Spain with an investment equal or higher than EUR 500,000 per applicant.

The residence permit will be given as well in case of an investment equal to or more than 2 M € in Spanish government bonds, 1 M € in shares of Spanish companies, or in bank deposits in Spanish financial institutions. Finally, a business project that will be developed in Spain, considered as general interest, will also allow the foreigner to get the residence permit.

It’s important to keep in mind that the investment can be carried out by a society owned by the applicant and established in a territory not considered a tax haven.

Permit’s duration

  • Visa for investors allows a residence permit  for one year.
  • The holder of this visa will be given an authorization for two more years residence, if he has been to Spain at least once during the first one year period and maintains the investment.
  • Having completed the three years of residence, foreign investors only have to request renewal to get the residence permit for another period of two years.
  • After these 5 years of residence, the foreigner will be given a permanent residence permit. Unlike the case of residence permits for investors, the applicant must have met the requirements of continuous residence.

Requirements Residence Visa

  • Not to be illegally in Spanish territory.
  • Be at least 18 years old.
  • No criminal record in Spain and in the countries where they have lived for the past five years, for offenses under the Spanish legal system.
  • Not included as rejectable in the territorial space of countries with which Spain has signed an agreement to that effect.
  • Have a health insurance with an Entity insurer authorized to operate in Spain.
  • Have sufficient resources for themselves and their family members during their period of residence in Spain.
  • Pay the fee for processing the permit or visa.

B. Entrepreneurs: 

Similarly, foreigners who are seeking entry to Spain or who are holders of an authorization or residence visa and are seeking to initiate or develop an economic activity as entrepreneur may be provided with a residence permit for business. In this case entrepreneurship is understood that is innovative for his special economic interest to Spain and have a favorable report from the Spanish Administration. For the assessment the Government will consider as a priority creating jobs in Spain.

In all these cases, the applicant has to accomplish the general requirements for the residence visa.
